Every few years, the Council on State Taxation (COST), puts out a national study where it compares state's tax appeals proccesses and procedural requirements and assigns each a "grade report." In their most recent report released December 2016, North Dakota was one of the two lowest scoring states with a D+ (shared by Nevada). This is down from the C they scored in their 2013 report.

States are evaluated on:

  • If the state tax appeals process is independent of tax department, such as through the use of an independent, tax court or tribunal (also considered is whether the appeals judges are required to have experience in evaluating the complexities of state tax law, and whether the taxpayer has opportunity for "hearing of record" at court or tribunal that would form basis of further appeals)
  • If a taxpayer must prepay the disputed tax or assessment prior to an opportunity for an independent hearing
  • Even-handed statutes of limitations for refunds and assessments
  • Equalized interest rates on refunds and assesssments
  • Adequate time to file protest before an independent dispute forum
  • Reasonable and clearly defined procedures for filing amended state income/franchise tax returns following adjustments
  • Transparency in the form of published letter rulings (redacted) and administrative/tax tribunal decisions

State Tax Valuation Resolutions Accepted and Passed

VWND's Industrial Valuation committee has been working hard to have their issues and concerns regarding locally and centrally assessed tax procedures heard and acted upon. Two resolutions regarding these concerns have been accepted and passed, one by the North Dakota Association of Counties, and one by the Western Dakota Energy Assocation.

Hazen Pioneer

Apartments Project

" It’s our hope and wish to dedicate the Hazen Pioneer Apartments to Hazen residents and to stay as local as we can. We want to try to take care of our hometown folks first" - Buster Langowski, Hazen Community Development

The Hazen Pioneer Apartments is an 18-unit complex being developed for the 55 and older tenant in Hazen, ND. It was awarded a $2 million grant through the North Dakota Housing Finance Agency’s tax incentive program, and another $2 million in bond financing is being utilized for the project.

Buster also adds that, " the project got delayed a bit because of some engineering issues so we’re looking at an anticipated opening date of October 1, 2017, instead of July 1, 2017. The waiting list is filling up, we now have solid leads on 15 potential clients."

  • Under the Go Local!ND initiative, Vision West ND brought expert "localist" Kimber Lanning from Local First Arizona to western North Dakota on December 12th - 13, 2016 to share about her strategies and successes for "going local." She visited Beulah with the help of the Beulah Chamber of Commerce and Mercer County JDA, Stanley in partnership with Mountrail County and Stanley Commercial Club, and Dickinson in partnership with the Dickinson Downtown Association.   • The 2017 North Dakota Legislative Session kicked off on Jan. 3 in Bismarck, ND. Vision West ND will be keeping an eye on all issues relevant to consortium goals and objectives. CLICK on the image to the right to read about the upcoming Southwest Night with the Legislators being held in Bismarck, ND on January 23rd. Vision West ND is a $500 sponsor for this event.

  • The 2017 grant round for the ND REAP Set-Aside Funds from USDA-RD is now open, and closes on March 31, 2017. CLICK on the image to the left for further information about this funding opportunity.

  • The Fifth Annual ND Reclamation Conference is coming to Dickinson, ND on Feb. 20-21, 2017 with Keynote Speacker Darryl R. Nelson from NELSON Environmental Remediation Ltd. CLICK on the image below for more information and registration for this event.

  • Geoff Simon has been named the new Executive Director of the Western Dakota Energy Association (formerly known as the North Dakota Association of Oil and Gas Producing Counties)! He took on his new position Oct. 1 and worked jointly with retiring executive director, Vicky Steiner, until December 31. Worth a Chuckle...

An Executive Director, a Development Director, and a board chair were adrift on a raft after their ship sank. The board chair looked at the ED and said, “This is all your fault. You were steering the boat!” The ED looked at the DD and said, “No, it’s all the DD’s fault. She oversaw the sails.” The DD said, “It’s both your faults. You were steering the boat, but you were charting the course.” All three were devoured by sharks. It was the worst board/staff retreat ever and the organization never used that team building company again.
